In einem Schreiben vom 25.5.1996 von THE an NOA heißt es: "Wir [THE] müssen auf dem Gebiet des Preises konkurrieren, um den Marktanteil bei Nintendo-Marken zu halten, und als Folge davon sind graue Exporte von Großbritannien auf das europäische Festland attraktiv. Trotzdem haben wir bisher alles Mögliche unternommen, um diese Praktik zu unterbinden. [...]*", (S. 890). In einem Fax von THE an die [...]* vom 28.6.1996 wurde erklärt: "Lassen Sie mich Ihnen versichern, dass wir alles Mögliche tun, um unsere Produkte auf unser Absatzgebiet zu beschränken und dass jede Unterstützung, die wir von unseren europäischen Partnern/Kollegen erhalten können, sehr willkommen sein wird. Ich bin sicher, dass wir in dieser Frage zusammenarbeiten und zwischen uns den Umfang der grauen Importe minimieren können" (S. 1198). (183) S. 963 und 1119. (184) S. 1136. (185) S. 976 und 1136. Dieses Schreiben wurde als Antwort auf ein Schreiben vom 14. März 1996 von den Rechtsvertretern von [...]* abgefasst. Das Vorgehen von THE gegen dieses Unternehmen begann daher in der Zeit, wo Nintendo THE boykottierte. THE gab ähnliche Erklärungen in seinem Schreiben an die Rechtsvertreter von [...]* vom 23. April 1996, S. 923. (199) S. 920 und 921. (200) Schreiben vom 23.4.1996 von THE an den Rechtsvertreter von [...]*, S. 923 und 924. Dieses Schreiben enthält auch eine ausführliche Darstellung der Maßnahmen, die THE gegenüber [...]* ergriffen hat, sowie erneute Versicherungen, dass es die notwendigen Schritte unternehmen würde, um den Verkauf von THE-Produkten an den britischen Markt einzuschränken.
