Responsibility of the group works council

The responsibility of the group works council is determined in accordance with Section 58 BetrVG. According to the theory of “subjective impossibility” developed by the Federal Labor Court, the central works council or the group works council can also be responsible if the employer only provides a voluntary service on a company or cross-company basis.
