Responsibility of the group works council
The responsibility of the group works council is determined in accordance with Section 58 BetrVG. In its judgment of June 19, 2007 ( 1 AZR 454/06 ), the First Senate decided that the original responsibility of the group works council in accordance with. It can arise for technically or legally objectively compelling reasons. The principle of equal treatment does not generally create a legal need for cross-company, group-wide regulations. According to the theory of “subjective impossibility” developed by the Federal Labor Court, the central works council or the group works council can also be responsible if the employer only provides a voluntary service on a company or cross-company basis.
