Real estate law and real estate law include all legal regulations that deal with the legal relationships and rights to land, houses and condominiums.

In real estate law and real estate law, you can have various rights to a piece of land; these are referred to as real rights. The strongest right is property, § 903 BGB. Legally, the house and the property essentially form a unit, so you basically have ownership of the property including the house. However, one can also only have individual rights to a property; these limited real rights include, for example, easement or usufruct. The owner of a property can also encumber his property under real estate law and real estate law, for example with a mortgage or land charge. These are security measures that serve to secure claims.

In order to know who has which rights to a property, the respective rights and legal changes in property law and real estate law are entered in the land register, cf. §§ 873 ff. BGB. In this way, every legal change to the property is documented and the greatest possible legal certainty is created in property law and real estate law.

Since livelihoods often depend on real estate and the processing is complex, in real estate law and real estate law, the sale of a property requires a notarial certification, cf. § 311 b I BGB.
