Traffic Law
STEINWACHS Law Firm offers consultation in traffic law covering all areas of Germany’s and other European countries’ (road) traffic law. This is becoming more and more important due to the EU-wide enforcement agreement on motoring fines introduced in 2010.
If you are on the road in a foreign country, you are subject to the local traffic laws (speed limits, parking restrictions, right-of-way rules). Foreign sanctions and procedural regulations are often very different from the German ones. For instance, a vehicle owner abroad (for example in Italy, Belgium, the Netherlands) often faces a liability for traffic disruptions which is fundamentally different from German traffic regulations.
While traffic violations abroad used to pose a problem only upon reentry into the country in question, more and more drivers are now being called to account for their offenses already upon return to Germany, with many countries punishing traffic offenses far more severely than Germany.
Road traffic law comprises mainly the following sub-areas:
Civil traffic law, especially liability issues (e.g. in the case of accidents) and traffic contract law (purchase and sale of vehicles, repairs, etc.)
Criminal traffic law and administrative offenses (fines, warnings)
Driving license law
Registration law
Our main task in the field of traffic law is the handling of claims. After a traffic accident, we will assert your claims for damages and compensations against the other parties involved in the accident as well as their insurances, and we will defend you when faced with corresponding claims.
Negotiating claims autonomously with the opponent’s insurance often leads to disadvantages for the person attempting such negotiations. Unspecialized lawyers make many mistakes in this field, too. In particular, the most significant item of damages – the so-called housekeeping damage, which refers to additional costs incurred due to physical injury after an accident – is frequently overlooked.
