The VW emissions scandal concerns vehicles whose emissions-control systems gave rise to legal disputes. A possible claim cannot be assessed from the brand name alone. The vehicle, engine, purchase circumstances and relevant conduct must be identified before the applicable legal basis can be examined.
Possible claims require specific facts
Section 826 BGB concerns intentional harm contrary to public policy. Its requirements must be demonstrated in the individual case; the existence of an emissions issue does not by itself establish every element. The relevant case law must also match the vehicle and circumstances.
Documents for an assessment
Keep the purchase agreement, vehicle identification, registration documents, recall or update notices and previous correspondence. Record purchase dates, what was known at the relevant times and any previous proceedings. Limitation and earlier settlements require a separate examination.
