Treatment contract

A treatment contract is a legal contract between a patient and a doctor or medical provider. The contract arises when a patient uses the services of a doctor or a medical facility and the doctor or the facility offers the medical treatment.

  • Agreement on Treatment: The contract specifies what type of medical treatment or service the doctor will provide. This may include medical consultation, diagnosis, medical examination, drug treatment, surgery or other forms of medical care.
  • Patient consent: The patient gives consent to treatment after being informed of the possible risks, alternatives and expected benefits. This is often referred to as informed consent.
  • Duties of the doctor: The doctor undertakes to carry out medical treatment in accordance with accepted medical standards and his professional ethics. He has a duty of care to act correctly and professionally towards the patient.
  • Obligations of the patient: The patient is obliged to provide the doctor with all relevant information about his state of health and his medical history. The patient must also follow the doctor’s instructions and fulfill his obligations to cooperate, e.g. B. taking prescribed medication or following aftercare instructions.
  • Payment Arrangements: The contract may also specify payment terms and responsibility for paying for medical services.

The treatment contract forms the legal basis for medical care and defines the rights and obligations of both the patient and the doctor. If the treatment contract is breached, the patient can take legal action and claim damages.
