B\u00f6yle bir ofisin ve ilgili g\u00f6revlerin devri, i\u015f s\u00f6zle\u015fmesi taraflar\u0131n\u0131n anla\u015fmas\u0131n\u0131 gerektirir.   <em>(bkz. BAG 13 Mart 2007 \u2013 9 AZR 612\/05 -). <\/em>\u00c7al\u0131\u015fan\u0131n mevcut i\u015f ili\u015fkisinde veri koruma g\u00f6revlisi olarak atanmas\u0131 halinde bu, Onuncu Senato&#8217;nun 29 Eyl\u00fcl 2010 tarihli karar\u0131na dayanmaktad\u0131r. <em>(- 10 AZR 588\/09 -)<\/em> d\u00fczenli olarak i\u015fverenin, yasal h\u00fck\u00fcmlere uygun olarak i\u015f s\u00f6zle\u015fmesinin s\u00fcresi boyunca ofisle ilgili g\u00f6revleri de kapsayacak \u015fekilde uzat\u0131lmas\u0131 y\u00f6n\u00fcnde teklifte bulunmas\u0131. \u00c7al\u0131\u015fan\u0131n atamay\u0131 kabul ederek bu teklifi kabul etmesi halinde, g\u00f6revin devri s\u00fcresince i\u015f s\u00f6zle\u015fmesi de\u011fi\u015ftirilecektir. Talimat verme hakk\u0131<\/strong><\/p>\n<p>Dokuzuncu Senato&#8217;nun 23 \u015eubat 2010 tarihli karar\u0131na g\u00f6re (- 9 AZR 3\/09 -), bir edit\u00f6r\u00fcn i\u015f s\u00f6zle\u015fmesindeki, i\u015fverenin ona di\u011fer editoryal veya gazetecilik g\u00f6revlerini devretme yetkisine sahip oldu\u011funu belirten bir madde, i\u015fverenin edit\u00f6r\u00fc, yaln\u0131zca yeni yay\u0131nc\u0131l\u0131k \u00fcr\u00fcnleri i\u00e7in test makaleleri geli\u015ftirmek zorunda oldu\u011fu bir hizmet ve geli\u015ftirme edit\u00f6r ekibine yerle\u015ftirmesi. K\u0131s\u0131m, II. K\u0131sm\u0131ndaki \u00e7al\u0131\u015fma s\u00fcresi d\u00fczenlemelerinin a\u015fa\u011f\u0131dakilerle uyumlulu\u011funu incelemek zorundayd\u0131: ArbZG. Belediye \u015firketlerinin istihdam ili\u015fkilerini s\u00fcrd\u00fcr\u00fcrken personel temini yoluyla bu g\u00f6revi y\u00fcr\u00fctebilmeleri i\u00e7in arsa tahsisi yap\u0131lm\u0131\u015ft\u0131r. D\u00fczenleme i\u00e7erik dinamik de\u011fil, yaln\u0131zca zaman dinamik olacak \u015fekilde tasarland\u0131\u011f\u0131ndan, genel olarak federal ve yerel y\u00f6netimler i\u00e7in 1 Ekim 2005 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren kamu hizmeti toplu s\u00f6zle\u015fmesini kapsamamaktad\u0131r. <\/p>\n<p> <em>(TV\u00f6D)<\/em> ne de 1 Kas\u0131m 2006&#8217;da y\u00fcr\u00fcrl\u00fc\u011fe giren eyaletlerin kamu hizmetlerine ili\u015fkin toplu s\u00f6zle\u015fme <em>(TV-L).<\/em> Ancak y\u00f6nlendirmenin dinamik tasar\u0131m\u0131, taraflar\u0131n \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 kamu hizmetindeki toplu pazarl\u0131k geli\u015fmeleriyle dinamik olarak uyumlu hale getirme arzusuyla sonu\u00e7lan\u0131r. Tarife halefiyeti ve an\u0131lan tarife \u00e7er\u00e7evesinin devam ettirilememesi sonucunda dinamik referans maddesi eksik kalm\u0131\u015ft\u0131r. Y\u00f6netmeliklerdeki bu bo\u015flu\u011fun, bunlar\u0131n yerine ge\u00e7en tarife d\u00fczenlemelerinin de dikkate al\u0131nmas\u0131 i\u00e7in ek bir s\u00f6zle\u015fme yorumuyla kapat\u0131lmas\u0131 gerekmektedir. Ekim 2005&#8217;e kadar b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ayn\u0131 olan toplu i\u015f s\u00f6zle\u015fmesi d\u00fczenlemelerinin TV\u00f6D ve TV-L olarak ikiye ayr\u0131lmas\u0131 nedeniyle, i\u015f s\u00f6zle\u015fmesinin taraflar\u0131n\u0131n hangi yeni d\u00fczenleme \u00fczerinde anla\u015fmaya varacaklar\u0131n\u0131n da belirlenmesi gerekmektedir. ek s\u00f6zle\u015fmenin yorumlanmas\u0131. \u015e\u00fcphe durumunda, ger\u00e7ekle\u015ftirilen faaliyetlerin kamu hizmeti kapsam\u0131nda y\u00fcr\u00fct\u00fclmesi durumunda genellikle ge\u00e7erli olacak toplu s\u00f6zle\u015fme budur.    <\/p>\n<p><strong>6. \u0130\u015f g\u00fcvenli\u011fi uzman\u0131<\/strong><\/p>\n<p>ASiG&#8217;in 8. maddesinin 2. f\u0131kras\u0131na g\u00f6re, i\u015f g\u00fcvenli\u011fi uzmanlar\u0131 veya bir \u015firkete birden fazla uzman\u0131n atanmas\u0131 durumunda k\u0131demli i\u015f g\u00fcvenli\u011fi uzman\u0131 do\u011frudan \u015firket ba\u015fkan\u0131na rapor verir. Dokuzuncu Senato&#8217;nun 15 Aral\u0131k 2009 tarihli karar\u0131na g\u00f6re <em>(- 9 AZR 769\/08 -),<\/em> d\u00fczenleme, i\u015fverene, istihdam etti\u011fi &#8211; y\u00f6netici &#8211; i\u015f g\u00fcvenli\u011fi uzman\u0131n\u0131, \u015fartlar a\u00e7\u0131s\u0131ndan do\u011frudan \u015firket ba\u015fkan\u0131na bildirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirmektedir. Hem teknik hem de disiplin konular\u0131nda. Bu gereklilik kamu y\u00f6netimi alan\u0131nda da ge\u00e7erlidir. ASiG do\u011frudan orada ge\u00e7erli de\u011fildir.
