Kira kontrol\u00fcne tabi olmayan daireler i\u00e7in kiran\u0131n artma ihtimali mevcuttur. Kira art\u0131\u015f\u0131n\u0131n ilk \u015fart\u0131 her zaman ev sahibinin kirac\u0131ya resmi ve maddi olarak hukuka uygun bir kira art\u0131\u015f\u0131 talebidir. Uygulamada, kira art\u0131\u015f taleplerinin yar\u0131s\u0131ndan fazlas\u0131n\u0131n resmi gereklilikleri kar\u015f\u0131lamad\u0131\u011f\u0131 ve dolay\u0131s\u0131yla etkisiz oldu\u011fu varsay\u0131labilir. Ev sahipleri i\u00e7in a\u015fa\u011f\u0131dakiler ge\u00e7erlidir: Yasal olarak do\u011frulanmayan bir kira art\u0131\u015f\u0131 talebinin yasal olarak ge\u00e7erli olma \u015fans\u0131 genellikle \u00e7ok azd\u0131r. Kendi tecr\u00fcbemiz g\u00f6sterdi ki, Hamburg&#8217;da 100.000&#8217;in \u00fczerinde daire kiralayan bir \u015firket bile, kullan\u0131lan kira art\u0131\u015f talebine y\u00f6nelik resmi itirazlar\u0131m\u0131za dayanamad\u0131 ve kendisine daha fazla zarar vermemek i\u00e7in davay\u0131 geri \u00e7ekmek zorunda kald\u0131. Ayn\u0131 sebepten dolay\u0131 a\u015fa\u011f\u0131dakiler ge\u00e7erlidir: \u00d6nce hukuki tavsiye almadan onay\u0131n\u0131z\u0131 vermeyin. Kira art\u0131\u015f talebini ald\u0131\u011f\u0131n\u0131z ay\u0131n geri kalan\u0131 ve takip eden iki ay boyunca s\u00fcrecek olan onay s\u00fcresinin dikkate al\u0131nmas\u0131 gerekir. B. kendi kendini finanse eden veya kamu taraf\u0131ndan finanse edilen modernizasyon tedbirleri i\u00e7in. Maddesi uyar\u0131nca, yaln\u0131zca kiran\u0131z\u0131n art\u0131\u015f tarihinde on be\u015f ay boyunca de\u011fi\u015fmemi\u015f olmas\u0131 durumunda (bloke s\u00fcresi) kira art\u0131\u015f\u0131 talep edebilir.<\/li>\n<li>Ancak modernizasyondan kaynaklanan kira art\u0131\u015flar\u0131 veya i\u015fletme maliyetlerindeki art\u0131\u015flar dikkate al\u0131nmaz.<\/li>\n<li>Madde 558&#8217;e g\u00f6re ilk kira art\u0131\u015f\u0131, kira s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131ndan itibaren en erken bir y\u0131l ge\u00e7medik\u00e7e ger\u00e7ekle\u015fmeyebilir.<\/li>\n<li>Yerel kar\u015f\u0131la\u015ft\u0131rmal\u0131 kira a\u015f\u0131lmamal\u0131d\u0131r.<\/li>\n<li>Kira, \u00fc\u00e7 y\u0131l i\u00e7inde en fazla %20 oran\u0131nda art\u0131r\u0131labilir (tavan s\u0131n\u0131r\u0131).
