Toplu pazarl\u0131\u011fa tabi olanlar\u0131n g\u00fcveninin korunmas\u0131, e\u011fer ilgili d\u00fczenlemenin beklenmesi gerekiyorsa geriye d\u00f6n\u00fck toplu s\u00f6zle\u015fmeyle \u00e7eli\u015fmez.<\/p>\n<p>B\u00f6lgesel toplu s\u00f6zle\u015fme yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn b\u00f6lge \u00fcst\u00fc toplu s\u00f6zle\u015fmede a\u00e7\u0131k\u00e7a d\u00fczenlenmesi durumunda bu durum zaten s\u00f6z konusudur. D\u00f6rd\u00fcnc\u00fc Senato ayr\u0131ca 11 Ekim 2006 tarihli bir kararla (4 AZR 486\/05) toplu s\u00f6zle\u015fmeler yoluyla toplu pazarl\u0131k haklar\u0131na geriye d\u00f6n\u00fck m\u00fcdahaleyi ele ald\u0131. Bu karara g\u00f6re toplu s\u00f6zle\u015fme taraflar\u0131, bir toplu s\u00f6zle\u015fmeyi s\u00fcresi i\u00e7inde geriye d\u00f6n\u00fck olarak de\u011fi\u015ftirebilir ve toplu s\u00f6zle\u015fme haklar\u0131na m\u00fcdahale edebilir. Tasar\u0131m\u0131n bu kapsam\u0131, standarda tabi olanlar\u0131n korunmaya de\u011fer g\u00fcveniyle s\u0131n\u0131rl\u0131d\u0131r.
