Federal \u0130\u015f Mahkemesi&#8217;nin yerle\u015fik i\u00e7tihad\u0131na g\u00f6re, i\u015fveren taraf\u0131ndan mevcut \u00fccretlendirme ilkelerinde yap\u0131lacak de\u011fi\u015fiklikler de ortak karara tabidir. Birinci Senato, \u00f6nceki i\u00e7tihad\u0131n\u0131 s\u00fcrd\u00fcrerek, 28 \u015eubat 2006 (1 ABR 4\/05) tarihli karar\u0131nda, toplu s\u00f6zle\u015fmenin bulunmamas\u0131 durumunda, i\u015fverenin, \u00e7al\u0131\u015fanlar\u0131n \u00fccretleri i\u00e7in gelecekte sa\u011flayaca\u011f\u0131 toplam fon miktar\u0131n\u0131 s\u0131n\u0131rlamas\u0131 gerekti\u011fine karar vermi\u015ftir. bireysel s\u00f6zle\u015fmelere halel getirmeksizin Ba\u011flamalar ortak karar al\u0131nmadan azalt\u0131labilir. Ancak kalan \u00fccret konusunda y\u00fcr\u00fcrl\u00fckteki \u00fccretlendirme esaslar\u0131na uymak ve de\u011fi\u015fiklik olmas\u0131 halinde i\u015f konseyinin onay\u0131n\u0131 almak zorundad\u0131r. Toplu olmayan i\u015fveren, i\u015f s\u00f6zle\u015fmesinde \u00e7al\u0131\u015fanlar\u0131 ile, farkl\u0131 maa\u015f gruplar\u0131 i\u00e7in ayn\u0131 miktarda bu t\u00fcr yard\u0131mlar\u0131 sa\u011flayan ek \u00fccretler, \u00f6denekler, tatil \u00fccretleri ve y\u0131ll\u0131k \u00f6deneklere ili\u015fkin toplu s\u00f6zle\u015fmelerin uygulanmas\u0131 konusunda anla\u015fmaya varm\u0131\u015fsa, bu yard\u0131mlar da yeni i\u015fe al\u0131nan t\u00fcm \u00e7al\u0131\u015fanlar i\u00e7in tamamen iptal edilecektir. \u00c7al\u0131\u015fanlar\u0131n ortak karar almas\u0131 gereken mevcut \u00fccretlendirme esaslar\u0131nda de\u011fi\u015fiklik yap\u0131labilir.<\/p>\n<p>\u0130\u015fverenin, t\u00fcm \u00e7al\u0131\u015fanlar\u0131n ayl\u0131k \u00fccretine e\u015fit oranda kar\u015f\u0131l\u0131k gelen bir \u00f6dene\u011fi veya \u00f6zel \u00f6demeyi iptal etmesi durumunda, ilgili toplam \u00fccret aras\u0131ndaki nispi fark de\u011fi\u015fmez. Mevcut \u00fccretlendirme esaslar\u0131nda yap\u0131lan de\u011fi\u015fiklik, toplam \u00fccretin ilerleyen k\u0131s\u0131mlar\u0131nda belirli bir tarihte tek seferlik ek \u00f6deme olarak \u00f6denmeyecek, bunun yerine toplam \u00fccretin ayn\u0131 ayl\u0131k tutarlar \u00fczerinden da\u011f\u0131t\u0131lmas\u0131ndan kaynaklanmaktad\u0131r. 18 Temmuz 2006 tarihli bir kararda (1 AZR 578\/05), Birinci Senato, bir i\u015f s\u00f6zle\u015fmesine dayanan \u00fccret haczi i\u015flemleri i\u00e7in i\u015fverenin \u00fccretlerden stopaj yapmas\u0131n\u0131n kabul edilebilirli\u011fini ele ald\u0131. \u0130\u015fveren d\u00fczenli olarak \u00fccret veya maa\u015f hacizlerinin i\u015flenmesiyle ilgili masraflara katlan\u0131r. Bunlar onun kendi y\u00fck\u00fcd\u00fcr. \u00c7al\u0131\u015fana kar\u015f\u0131 ne yasal bir tazminat talebi vard\u0131r ne de b\u00f6yle bir talep (g\u00f6n\u00fcll\u00fc) bir \u015firket s\u00f6zle\u015fmesiyle hakl\u0131 g\u00f6sterilebilir. \u00dccretin haczi, \u00e7al\u0131\u015fanlar\u0131n \u015firket d\u0131\u015f\u0131ndaki, \u015firket taraflar\u0131n\u0131n kontrol\u00fc d\u0131\u015f\u0131ndaki davran\u0131\u015flar\u0131n\u0131 ilgilendirmektedir. \u00dccret haczi durumunda maliyetlerin da\u011f\u0131t\u0131m\u0131na ili\u015fkin d\u00fczenleme, B\u00f6l\u00fcm 87 (1) uyar\u0131nca zorunlu ortak belirleme konusunu etkilemez. 1 BetrVG, \u00a7 88 BetrVG, \u00e7al\u0131\u015fanlar\u0131n bireysel hukuki konumlar\u0131na bu \u015fekilde m\u00fcdahale edilmesine h\u00e2l\u00e2 izin vermektedir.<\/p>\n<p>Prensip olarak \u015firket taraflar\u0131, konu B\u00f6l\u00fcm 77 Para. 1 kapsam\u0131nda yer almad\u0131\u011f\u0131 s\u00fcrece sosyal konularda kapsaml\u0131 d\u00fczenleme yetkisine sahiptir. 3 BetrVG toplu s\u00f6zle\u015fmeyle d\u00fczenlenir veya genellikle d\u00fczenlenir. Joya. \u00a7 98 Abs. 3, Abs. 4 BetrVG, i\u015f konseyi belirli ko\u015fullar alt\u0131nda \u00e7al\u0131\u015fanlar\u0131n mesleki e\u011fitim tedbirlerine kat\u0131l\u0131m\u0131 konusunda \u00f6nerilerde bulunabilir ve i\u015fverenin bunlar\u0131 kabul etmemesi durumunda kat\u0131l\u0131mc\u0131lar\u0131n se\u00e7imine de karar verebilir. Kat\u0131l\u0131ma ili\u015fkin uygulanabilir bir ortak karar hakk\u0131, i\u015f konseyinin kat\u0131l\u0131mc\u0131lar\u0131n se\u00e7imi konusunda kendi \u00f6nerilerini sunmas\u0131n\u0131 ve i\u015fverenin bunlar\u0131 reddetmesini gerektirir. Bir yay\u0131nevinin bir edit\u00f6r\u00fc bir mesleki e\u011fitim program\u0131na g\u00f6ndermeyi d\u00fc\u015f\u00fcnmesi durumunda, 98. maddenin 1. paragraf\u0131 uyar\u0131nca ortak karar\u0131n uygulanmas\u0131 gerekir. 4 BetrVG, B\u00f6l\u00fcm 118 Paragraf\u0131na g\u00f6re e\u011filimlerin korunmas\u0131 nedeniyle. 1 C\u00fcmle 1 No. 2 BetrVG genel olarak hari\u00e7 tutulmu\u015ftur. Maddesi uyar\u0131nca yaln\u0131zca i\u015f konseyinin \u00f6neride bulunma ve bilgi alma hakk\u0131 vard\u0131r. 3 BetrVG, trend ta\u015f\u0131y\u0131c\u0131lar\u0131n\u0131n se\u00e7imi konusunda trend operasyonunda da ge\u00e7erlili\u011fini korur. Federal \u0130\u015f Mahkemesi&#8217;nin yerle\u015fik i\u00e7tihad\u0131na g\u00f6re s\u0131n\u0131fland\u0131rma, BetrVG&#8217;nin 99. Maddesi uyar\u0131nca i\u015f konseyinin dahil oldu\u011fu yasan\u0131n uygulanmas\u0131 eylemidir. \u0130\u015f konseyinin kat\u0131l\u0131m\u0131 do\u011frulu\u011fu kontrol etmeye yarar. Onuncu Senato, 28 Haziran 2006 (10 ABR 42\/05) tarihli karar\u0131yla bu i\u00e7tihad\u0131 do\u011frulad\u0131 ve toplu i\u015f s\u00f6zle\u015fmesine g\u00f6re yaln\u0131zca haftal\u0131k \u00e7al\u0131\u015fma saatlerindeki art\u0131\u015f\u0131n \u00e7al\u0131\u015fan\u0131n s\u0131n\u0131fland\u0131r\u0131lmas\u0131 a\u00e7\u0131s\u0131ndan ilgisiz oldu\u011funa karar verdi. \u00c7al\u0131\u015fan\u0131n ger\u00e7ekle\u015ftirdi\u011fi faaliyetin t\u00fcr\u00fc veya belirli \u00fccret gruplar\u0131nda ihtiya\u00e7 duyulan mesleki e\u011fitim belirleyicidir. Saat \u00fccretinin artt\u0131r\u0131lmas\u0131, e\u011fer toplu i\u015f s\u00f6zle\u015fmesine uygunsa, i\u015fveren taraf\u0131ndan planlanan bir s\u0131n\u0131fland\u0131rmay\u0131 i\u015f konseyinin onaylamay\u0131 reddetmesi i\u00e7in bir neden de\u011fildir. Toplu s\u00f6zle\u015fmenin sona ermesinden sonra i\u015fveren, yeni i\u015fe al\u0131nan bir \u00e7al\u0131\u015fanla toplu olarak kararla\u015ft\u0131r\u0131lan haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinden daha uzun bir \u00e7al\u0131\u015fma haftas\u0131 \u00fczerinde etkili bir \u015fekilde anla\u015fabilir. Toplu olarak kararla\u015ft\u0131r\u0131lan ayl\u0131k \u00fccret korunurken haftal\u0131k saatlik \u00fccrette b\u00f6yle bir art\u0131\u015f, \u00e7al\u0131\u015fan i\u00e7in daha d\u00fc\u015f\u00fck bir saatlik \u00fccrete yol a\u00e7ar, ancak \u00e7al\u0131\u015fan\u0131n hatal\u0131 bir \u015fekilde saatlik \u00fccretten ba\u011f\u0131ms\u0131z bir \u00fccret grubuna s\u0131n\u0131fland\u0131r\u0131ld\u0131\u011f\u0131 anlam\u0131na gelmez. Saatlik \u00fccretlerin azalt\u0131lmas\u0131ndan kaynaklanan dezavantaj, i\u015f konseyinin s\u0131n\u0131fland\u0131rmaya ili\u015fkin onay\u0131n\u0131 reddetme hakk\u0131n\u0131 vermez.<\/p>\n<p>c) Sosyal plan Birinci Senato, 28 Mart 2006 (1 ABR 5\/05) tarihli karar\u0131yla \u00f6nceki i\u00e7tihad\u0131n\u0131 do\u011frulad\u0131; buna g\u00f6re, B\u00f6l\u00fcm 111 BetrVG&#8217;ye g\u00f6re bu, ilgili say\u0131da \u00e7al\u0131\u015fan\u0131 etkilemesi ko\u015fuluyla, basit\u00e7e i\u015fg\u00fcc\u00fcn\u00fcn azalt\u0131lmas\u0131yla da ba\u015far\u0131labilir. B\u00f6l\u00fcm 17 KSchG&#8217;deki rakamlar bu a\u00e7\u0131dan belirleyicidir; b\u00fcy\u00fck \u015firketlerde i\u015fg\u00fcc\u00fcn\u00fcn en az y\u00fczde be\u015finin etkilenmesi gerekir. B\u00f6l\u00fcm 17 KSchG&#8217;deki rakamlar bu a\u00e7\u0131dan belirleyicidir; b\u00fcy\u00fck \u015firketlerde i\u015fg\u00fcc\u00fcn\u00fcn en az y\u00fczde be\u015finin etkilenmesi gerekir. Orijinal planlamaya g\u00f6re, \u015fu anlamda herhangi bir operasyonel de\u011fi\u015fiklik yoksa: BetrVG Madde 111&#8217;e g\u00f6re, \u00e7al\u0131\u015fma konseyinin ba\u015flang\u0131\u00e7ta bilgi, tavsiye ve sosyal plan\u0131n sonu\u00e7land\u0131r\u0131lmas\u0131 konusunda ortak karar verme hakk\u0131 yoktur. \u0130\u015fverenin, ba\u015flang\u0131\u00e7ta planlanan \u00f6nlemleri uygulamadan \u00f6nce planlamas\u0131n\u0131 de\u011fi\u015ftirmesi halinde, yeni planlama, ortak karar kanunu kapsam\u0131nda belirleyici olacakt\u0131r.
