B\u00f6yle bir iddia 612. Maddenin Paragraf\u0131ndan kaynaklanmamaktad\u0131r. 3 c\u00fcmle 1 BGB. Temizlik\u00e7i e\u015fde\u011fer faaliyetleri ger\u00e7ekle\u015ftirmiyor<\/p>\n<p>hay\u0131r kurumunun \u00e7al\u0131\u015ft\u0131rd\u0131\u011f\u0131 hamallar gibi. \u0130\u015f de\u011ferlendirmesinin nesnel standartlar\u0131na g\u00f6re ayn\u0131 i\u015f de\u011ferine sahipse i\u015f e\u015fit de\u011ferdedir. \u0130\u015fin e\u015fit de\u011ferde olup olmad\u0131\u011f\u0131 ancak bor\u00e7lu olunan i\u015fin bir b\u00fct\u00fcn olarak kar\u015f\u0131la\u015ft\u0131r\u0131lmas\u0131 yoluyla belirlenebilir. AVR DW kapsam\u0131nda hamal grubu \u00f6nemli \u00f6l\u00e7\u00fcde daha y\u00fcksektir. A\u011f\u0131r engellilik nedeniyle ayr\u0131mc\u0131l\u0131k<\/strong><\/p>\n<p>B\u00f6l\u00fcm 81 Paragraf\u0131na g\u00f6re. 2 C\u00fcmle 2 No. 3 C\u00fcmle 1 SGB IX, a\u011f\u0131r engelli stat\u00fcs\u00fc nedeniyle i\u015fe al\u0131n\u0131rken ayr\u0131mc\u0131l\u0131\u011fa u\u011frayan a\u011f\u0131r engelli ba\u015fvuru sahibi, e\u011fer bunu yaparsa \u00fc\u00e7 ayl\u0131k maa\u015f\u0131na kadar tazminat alma hakk\u0131na sahiptir. personel ayr\u0131m yap\u0131lmadan se\u00e7ilmi\u015f olsa bile i\u015fe al\u0131nmam\u0131\u015ft\u0131r. Bu ba\u011flamda Dokuzuncu Senato ayr\u0131ca, davac\u0131 ba\u015fvurucunun, a\u011f\u0131r engelli bir ki\u015finin stat\u00fcs\u00fcnden dolay\u0131 ayr\u0131mc\u0131l\u0131\u011fa u\u011frad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnd\u00fcren yard\u0131mc\u0131 ger\u00e7ekleri sunarak ve gerekirse kan\u0131tlayarak ispat y\u00fck\u00fcn\u00fc i\u015fverene y\u00fckleyebilece\u011fine karar vermi\u015ftir. \u0130\u015fverenin B\u00f6l\u00fcm 81 Para. 1&#8217;i ihlal etmesi durumunda b\u00f6yle bir dezavantaj her zaman varsay\u0131labilir. 1 C\u00fcmle 4 ve 6 SGB IX, a\u011f\u0131r engelli ki\u015filerin temsilcileri ba\u015fvuru s\u00fcrecine dahil de\u011fildir. A\u011f\u0131r engellilere y\u00f6nelik temsilci organ\u0131n g\u00f6revi, nitelikleri kar\u015f\u0131la\u015ft\u0131rarak pozisyonlar\u0131n ayr\u0131mc\u0131l\u0131k yap\u0131lmadan dolduruldu\u011funu kontrol etmektir. E\u011fer i\u015fveren a\u011f\u0131r engelli temsilcilerini bilgilendirmezse bu g\u00f6revi yerine getiremezler. Bu durum, i\u015f ba\u015fvurusunda bulunan a\u011f\u0131r engelli ki\u015finin dezavantajl\u0131 durumda oldu\u011fu varsay\u0131m\u0131n\u0131 olu\u015fturmaktad\u0131r.<\/p>\n<p>B\u00f6l\u00fcm 81 Paragraf\u0131na g\u00f6re. 4 C\u00fcmle 1 No. 1 SGB IX uyar\u0131nca, i\u015fveren, a\u011f\u0131r engelli \u00e7al\u0131\u015fan\u0131, \u00e7al\u0131\u015fan\u0131n beceri ve bilgilerini m\u00fcmk\u00fcn oldu\u011fu kadar tam olarak kullanabilece\u011fi ve daha da geli\u015ftirebilece\u011fi \u015fekilde istihdam etmelidir. Dokuzuncu Senato&#8217;nun 10 May\u0131s 2005 tarihli karar\u0131na g\u00f6re (- 9 AZR 230\/04 -), bu \u00f6zel istihdam hakk\u0131, i\u015fverenin talimat verme hakk\u0131na dayanarak \u00e7al\u0131\u015fana veremeyece\u011fi i\u015fleri de i\u00e7ermektedir. \u0130\u015f s\u00f6zle\u015fmesinde \u00f6nceden de\u011fi\u015fiklik yap\u0131lmas\u0131na gerek yoktur. \u00d6zel istihdam talebi do\u011frudan kanundan do\u011far ve s\u00f6zle\u015fmede \u00f6nceden de\u011fi\u015fiklik yap\u0131lmaks\u0131z\u0131n ileri s\u00fcr\u00fclebilir.<\/p>\n<p>\u0130ddiay\u0131 icra etmek i\u00e7in ibraz ve ispat y\u00fck\u00fc kademeli olarak kald\u0131r\u0131lm\u0131\u015ft\u0131r. \u00c7al\u0131\u015fan\u0131n, s\u0131n\u0131rl\u0131 performans\u0131n\u0131 g\u00f6stererek istihdam\u0131n\u0131n devam etti\u011fini iddia etmesi ve bilgi ve becerilerine uygun istihdam f\u0131rsatlar\u0131n\u0131 g\u00f6stermesi halinde talep kesin olarak sunulur. \u0130\u015fverenin buna somut bir \u015fekilde yan\u0131t vermesi ve \u00e7al\u0131\u015fana uygun engelli dostu bir istihdam\u0131n bulunmad\u0131\u011f\u0131n\u0131 g\u00f6steren ger\u00e7ekleri sunmas\u0131 gerekmektedir. Buna kar\u015f\u0131l\u0131k gelen bo\u015f pozisyon bulunmad\u0131\u011f\u0131n\u0131n ve transfer yoluyla kullan\u0131ma sunulamayaca\u011f\u0131n\u0131n a\u00e7\u0131klanmas\u0131 da dahildir. Dokuzuncu Senato&#8217;nun 4 Ekim 2005 tarihli karar\u0131na g\u00f6re (- 9 AZR 632\/04 -), bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn ihlali kabul\u00fcn gecikmesine yol a\u00e7maz. \u0130\u015fveren, i\u015f\u00e7inin bor\u00e7lu oldu\u011fu i\u015fi kabul etmemesi halinde ge\u00e7 kabul \u00fccretini \u00f6demek zorundad\u0131r. \u00c7al\u0131\u015fan\u0131n atanan i\u015fyerindeki faaliyetleri yerine getirememesi durumunda kabulde herhangi bir gecikme hakl\u0131 g\u00f6sterilemez (\u00a7 297 BGB). \u00c7al\u0131\u015fan\u0131n bunun yaln\u0131zca bir k\u0131sm\u0131n\u0131 yerine getirebilmesi durumunda, \u00e7al\u0131\u015fana kendisinin yerine getirebilece\u011fi ba\u015fka bir i\u015f atanmad\u0131\u011f\u0131 s\u00fcrece, \u00e7al\u0131\u015fan varsay\u0131lan olarak kabul edilmez (\u00a7 106 GewO). \u0130\u015fverenin genel olarak i\u015f organizasyonunu de\u011fi\u015ftirmesi veya \u00e7al\u0131\u015fan\u0131n i\u015fyerini teknik \u00e7al\u0131\u015fma yard\u0131mc\u0131lar\u0131 ile donatmas\u0131 gerekmemektedir. \u0130\u015fveren, i\u015fyerini B\u00f6l\u00fcm 81 Paragraf uyar\u0131nca engellilere uygun \u015fekilde tasarlama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ihlal ederse. 4 C\u00fcmle 1 No. 1, 4 ve 5 SGB IX, ancak kendisi zararlardan sorumludur.
