Yasal greve kat\u0131lman\u0131n hukuki sonucu, i\u015f ili\u015fkisinden kaynaklanan kar\u015f\u0131l\u0131kl\u0131 ana edim y\u00fck\u00fcml\u00fcl\u00fcklerinin iptalidir. Bu durum, orant\u0131l\u0131 \u00fccret talebinin kaybedilmesine yol a\u00e7maktad\u0131r. 26 Temmuz 2005 tarihli karar\u0131nda (- 1 AZR 133\/04 -) Birinci Senato, bu yasal sonu\u00e7lar\u0131n genellikle esnek \u00e7al\u0131\u015fma d\u00fczenlemesi uyguland\u0131\u011f\u0131nda da ge\u00e7erli olaca\u011f\u0131n\u0131 do\u011frulad\u0131. Ayr\u0131ca \u015firketin esnek \u00e7al\u0131\u015fma d\u00fczenlemesi kapsam\u0131nda izin verilen s\u00fcre kay\u0131t sisteminden \u00e7\u0131k\u0131\u015f yapt\u0131ktan sonra grev mitingine kat\u0131lan bir \u00e7al\u0131\u015fan\u0131n hukuki anlamda grevde olmad\u0131\u011f\u0131na karar verdi. \u015eirket zaman kayd\u0131ndan \u00e7\u0131k\u0131\u015f yapt\u0131ktan sonra \u00e7al\u0131\u015fan\u0131n serbest zaman\u0131 vard\u0131r. Grev, s\u00f6zle\u015fmeyle kararla\u015ft\u0131r\u0131lan \u00e7al\u0131\u015fma saatlerinin toplu olarak durdurulmas\u0131 anlam\u0131na geldi\u011finden, g\u00fcnl\u00fck \u00e7al\u0131\u015fma saatleri d\u0131\u015f\u0131nda grev g\u00f6sterisine kat\u0131lan bir \u00e7al\u0131\u015fan, yasal olarak greve gidemez. Greve bu \u015fekilde fiili kat\u0131l\u0131m\u0131n \u00fccret a\u00e7\u0131s\u0131ndan hi\u00e7bir sonucu yoktur. Bu durum i\u015f uyu\u015fmazl\u0131klar\u0131 hukuku gerek\u00e7eleriyle, \u00f6zellikle de m\u00fccadele e\u015fitli\u011fiyle \u00e7eli\u015fmemektedir. \u0130\u015fverenin kesinti nedeniyle tazminat \u00f6demesi gerekmiyor. Bor\u00e7lu olunan i\u015f miktar\u0131 de\u011fi\u015fmeden kal\u0131r. \u0130zin verilen saat s\u0131n\u0131r\u0131n\u0131n 150 eksi saat olarak belirlendi\u011fi esnek \u00e7al\u0131\u015fma s\u00fcresi d\u00fczenlemesi uyar\u0131nca, birden fazla \u00e7al\u0131\u015fan toplu olarak grev mitinglerine kat\u0131lmak \u00fczere kay\u0131tlar\u0131n\u0131 iptal etse bile, i\u015fveren buna kar\u015f\u0131 savunmas\u0131z de\u011fildir.
