Federal \u0130\u015f Mahkemesi&#8217;nin yerle\u015fik i\u00e7tihad\u0131na g\u00f6re, bir \u00e7al\u0131\u015fan, \u00f6zel hukuk kapsam\u0131ndaki bir s\u00f6zle\u015fmeye dayanarak ba\u015fka birinin hizmetinde, talimatlara tabi olarak d\u0131\u015far\u0131dan belirlenen i\u015fleri ki\u015fisel ba\u011f\u0131ml\u0131l\u0131kla yerine getirmekle y\u00fck\u00fcml\u00fc olan ki\u015fidir. S\u00f6zle\u015fmeye ba\u011fl\u0131 olarak bor\u00e7lu olunan hizmet, \u00fc\u00e7\u00fcnc\u00fc bir taraf\u00e7a belirlenen bir \u00e7al\u0131\u015fma organizasyonu \u00e7er\u00e7evesinde sa\u011flanmal\u0131d\u0131r. D\u0131\u015f i\u015f organizasyonuna entegrasyon, \u00f6zellikle \u00e7al\u0131\u015fan\u0131n s\u00f6zle\u015fme orta\u011f\u0131ndan (i\u015fveren) talimat verme hakk\u0131na tabi olmas\u0131 ger\u00e7e\u011finde a\u00e7\u0131k\u00e7a g\u00f6r\u00fclmektedir. Talimat verme hakk\u0131, faaliyetin i\u00e7eri\u011fi, uygulanmas\u0131, zaman\u0131, s\u00fcresi ve yeri ile ilgili olabilir. \u00c7al\u0131\u015fan, esas olarak i\u015fini organize etme ve \u00e7al\u0131\u015fma saatlerini belirleme \u00f6zg\u00fcrl\u00fc\u011f\u00fcne sahip olmayan bir \u00e7al\u0131\u015fand\u0131r. \u00d6te yandan, i\u015fini organize etme ve \u00e7al\u0131\u015fma saatlerini belirleme konusunda esasen \u00f6zg\u00fcr olan ki\u015fi serbest meslek sahibidir (HGB 84. Madde 1. F\u0131kra 2. C\u00fcmle). Bireysel vakan\u0131n t\u00fcm ko\u015fullar\u0131 dikkate al\u0131nmal\u0131 ve bir b\u00fct\u00fcn olarak de\u011ferlendirilmelidir. 25 May\u0131s 2005 tarihli bir kararla (- 5 AZR 347\/04 -) Be\u015finci Senato, k\u00fc\u00e7\u00fcklerin bak\u0131m\u0131na y\u00f6nelik bir a\u00e7\u0131k hava konut grubunun ba\u015fkan\u0131n\u0131n \u00e7al\u0131\u015fan stat\u00fcs\u00fcn\u00fc reddetti. Y\u00f6neticinin y\u00fcr\u00fctt\u00fc\u011f\u00fc \u00e7al\u0131\u015fma, esasen s\u00f6zle\u015fme orta\u011f\u0131 \u00d6zg\u00fcr ve Hansa \u015eehri Hamburg&#8217;un talimatlar\u0131ndan ba\u011f\u0131ms\u0131zd\u0131. Onlar\u0131n belirledi\u011fi herhangi bir bak\u0131m konseptine ba\u011fl\u0131 de\u011fildi. Esasen \u00e7al\u0131\u015fma saatlerini serbest\u00e7e d\u00fczenleyebiliyordu. A\u00e7\u0131k hava ya\u015fam grubunun yer se\u00e7imi konusunda talimat verme hakk\u0131na tabi de\u011fildi. Hizmet s\u00f6zle\u015fmesi kapsam\u0131nda denetleyici makam\u0131n talimatlar\u0131na uyma zorunlulu\u011fu oldu\u011fu \u00f6l\u00e7\u00fcde, bu durum talimatlara ba\u011f\u0131ml\u0131l\u0131kla sonu\u00e7lanmaz. Gen\u00e7lik refah\u0131 hukukunda denetleyici otoritenin kamu hukuku emirlerine uyma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc herkes i\u00e7in ge\u00e7erlidir. \u0130\u015f s\u00f6zle\u015fmesinde yer alan talimatlara ba\u011fl\u0131 kalmak bir \u00f6zellik de\u011fildir. \u00c7al\u0131\u015fan stat\u00fcs\u00fcyle ilgisi olmayan \u015fey, a\u00e7\u0131k hava ya\u015fam grubu y\u00f6neticisinin neredeyse hi\u00e7 ekonomik f\u0131rsat\u0131n\u0131n olmamas\u0131 ve herhangi bir giri\u015fimcilik riskine katlanmak zorunda olmamas\u0131d\u0131r. Bundan kaynaklanabilecek ekonomik ba\u011f\u0131ml\u0131l\u0131k, onlar\u0131n en iyi ihtimalle \u00e7al\u0131\u015fan benzeri bir ki\u015fi olarak g\u00f6r\u00fcnmesine neden olur. \u00c7al\u0131\u015fan benzeri ki\u015filer hakk\u0131nda, ihtiya\u00e7 duymalar\u0131 halinde i\u015f kanunu h\u00fck\u00fcmleri uygulan\u0131r. TVG&#8217;nin 12a maddesi, \u00e7al\u0131\u015fanlara benzer ki\u015filerden olu\u015fan bir grup i\u00e7in de toplu s\u00f6zle\u015fme yap\u0131labilece\u011fini \u00f6ng\u00f6rmektedir. TVG B\u00f6l\u00fcm 12a Paragraf 1 No. 1&#8217;in giri\u015f c\u00fcmlesinde yasama organ\u0131, \u00e7al\u0131\u015fan benzeri ki\u015fileri, ekonomik a\u00e7\u0131dan ba\u011f\u0131ml\u0131 ve bir \u00e7al\u0131\u015fanla kar\u015f\u0131la\u015ft\u0131r\u0131labilecek sosyal korumaya ihtiya\u00e7 duyan ki\u015filer olarak tan\u0131mlamaktad\u0131r. Dokuzuncu Senato&#8217;nun 15 \u015eubat 2005 tarihli karar\u0131na g\u00f6re (- 9 AZR 51\/04 -), toplu s\u00f6zle\u015fme taraflar\u0131, \u00e7al\u0131\u015fanlara benzer ki\u015filer i\u00e7in toplu s\u00f6zle\u015fmelerin kapsam\u0131n\u0131, kendilerine rehberlik edildi\u011fi s\u00fcrece belirlemeye yetkilidir. B\u00f6l\u00fcm 12 a TVG&#8217;nin yol g\u00f6sterici ilkesi. Yasama organ\u0131, \u00e7al\u0131\u015fan benzeri ki\u015filerden olu\u015fan grubu belirsiz yasal terimler kullanarak tan\u0131mlam\u0131\u015ft\u0131r. Bu mu\u011flak yasal \u015fartlar\u0131 doldurmak toplu pazarl\u0131k taraflar\u0131n\u0131n sorumlulu\u011fundad\u0131r. Burada, di\u011fer mevzuatta oldu\u011fu gibi, bir miktar yarg\u0131lama kapsam\u0131 vard\u0131r. IG Medien, Druck und Papier, Journalistik und Kunst, Alman \u00c7al\u0131\u015fanlar Sendikas\u0131 ve Alman Gazeteciler Birli\u011fi aras\u0131nda imzalanan 1 Temmuz 1996 tarihli, \u00e7al\u0131\u015fan benzeri ki\u015filerle ilgili toplu s\u00f6zle\u015fmenin 2. ve 3. paragraflar\u0131nda, toplu s\u00f6zle\u015fme taraflar\u0131 \u015funlar\u0131 belirtmi\u015ftir: ekonomik ba\u011f\u0131ml\u0131l\u0131k ve sosyal koruma ihtiyac\u0131 anlam\u0131nda B\u00f6l\u00fcm 12a TVG&#8217;de daha ayr\u0131nt\u0131l\u0131 olarak etkili bir \u015fekilde tan\u0131mlanm\u0131\u015ft\u0131r.
