L&rsquo;article 10, phrase 1 de l&rsquo;AGG autorise un traitement diff\u00e9rent en fonction de l&rsquo;\u00e2ge si celui-ci est objectif, appropri\u00e9 et justifi\u00e9 par un objectif l\u00e9gitime.<\/p>\n<p>En tant qu&rsquo;objectifs l\u00e9gitimes au sens de Selon l&rsquo;article 10, phrase 1 de l&rsquo;AGG, la d\u00e9cision doit \u00eatre prise non seulement en tenant compte de ceux qui sont dans l&rsquo;int\u00e9r\u00eat du grand public, mais \u00e9galement des int\u00e9r\u00eats op\u00e9rationnels et li\u00e9s \u00e0 l&rsquo;entreprise. Cr\u00e9er et garantir une structure de personnel \u00e9quilibr\u00e9e peut \u00eatre consid\u00e9r\u00e9 comme un objectif l\u00e9gitime. Pour ce faire, l&#8217;employeur doit expliquer quelle structure sp\u00e9cifique du personnel il souhaite cr\u00e9er ou maintenir et pour quelles raisons. Il ne suffit pas que l\u2019employeur \u00e9voque simplement une \u00ab structure du personnel \u00e9quilibr\u00e9e \u00bb ou pr\u00e9tende qu\u2019il a besoin d\u2019une structure d\u2019\u00e2ge diff\u00e9rente.<\/p>\n<p>La demande d&rsquo;indemnisation selon l&rsquo;article 15 al. 2 AGG en raison d&rsquo;un pr\u00e9judice moral d\u00fb \u00e0 une violation de l&rsquo;interdiction de discrimination ne pr\u00e9suppose pas un comportement coupable de la part de l&#8217;employeur. Il n\u2019est pas n\u00e9cessaire que l\u2019employ\u00e9 ait vu ses droits personnels g\u00e9n\u00e9raux viol\u00e9s. Si l&#8217;employeur viole l&rsquo;interdiction de discrimination, on peut g\u00e9n\u00e9ralement supposer que le salari\u00e9 subira un pr\u00e9judice immat\u00e9riel. 2009 (1 ABR 47\/08) selon l&rsquo;article 3 al. 2 AGG peut \u00eatre une discrimination indirecte inadmissible en raison de l&rsquo;\u00e2ge. Les salari\u00e9s qui ont travaill\u00e9 plusieurs ann\u00e9es sont g\u00e9n\u00e9ralement plus \u00e2g\u00e9s que les salari\u00e9s qui en sont \u00e0 leur premi\u00e8re ann\u00e9e de travail.<\/p>\n<p>Une telle restriction peut \u00eatre justifi\u00e9e si l&#8217;employeur poursuit un objectif l\u00e9gitime et si elle est proportionn\u00e9e et n\u00e9cessaire pour atteindre cet objectif. Si les raisons invoqu\u00e9es par l&#8217;employeur sont manifestement inappropri\u00e9es, l&#8217;employeur viole gravement son obligation de faire de la publicit\u00e9 sans discrimination conform\u00e9ment \u00e0 l&rsquo;article 11 de l&rsquo;AGG. Lier la dur\u00e9e de la p\u00e9riode professionnelle\/d&rsquo;activit\u00e9 \u00e0 l&rsquo;\u00e2ge et les effets qui en d\u00e9coulent sur le groupe de candidats \u00e0 l&rsquo;offre d&#8217;emploi interne n&rsquo;\u00e9tait \u00e9videmment pas adapt\u00e9 pour atteindre les objectifs de l&#8217;employeur consistant \u00e0 garantir une structure d&rsquo;\u00e2ge \u00e9quilibr\u00e9e et \u00e0 limiter les co\u00fbts de personnel.
