La nouvelle loi n&rsquo;est applicable que si des faits survenus apr\u00e8s le 17 ao\u00fbt 2006 sont pertinents pour les interdictions de discrimination de l&rsquo;AGG. La r\u00e9glementation transitoire de l&rsquo;article 33, paragraphe 1, de l&rsquo;AGG fait donc r\u00e9f\u00e9rence \u00e0 toutes les discriminations non autoris\u00e9es survenues avant l&rsquo;entr\u00e9e en vigueur de l&rsquo;AGG, y compris les discriminations dues \u00e0 un handicap. L&rsquo;ancienne situation juridique, y compris l&rsquo;article 81, paragraphe 2, SGB IX, s&rsquo;applique \u00e0 ces inconv\u00e9nients. Le moment est celui o\u00f9 l\u2019acte de discrimination a eu lieu. Dans l&rsquo;affaire tranch\u00e9e par le Neuvi\u00e8me S\u00e9nat le 16 septembre 2008 ( 9 AZR 791\/07 ), l&rsquo;acte \u00e9tait la d\u00e9cision de ne pas employer le demandeur demandeur avant le 18 ao\u00fbt 2006. Le d\u00e9lai de trois mois pour d\u00e9poser une plainte en vertu de l&rsquo;article 61b (1) de la nouvelle version de l&rsquo;ArbGG ne s&rsquo;applique pas encore aux demandes d&rsquo;indemnisation fond\u00e9es sur une discrimination en raison d&rsquo;un handicap qui ont \u00e9t\u00e9 compl\u00e9t\u00e9es avant le 17 ao\u00fbt. Le d\u00e9lai pour intenter une action en justice en vertu de l&rsquo;article 61b de l&rsquo;ArbGG (ancienne version) \u00e9tait limit\u00e9 aux demandes d&rsquo;indemnisation pour discrimination li\u00e9e au sexe. Si un candidat indique son handicap grave dans la lettre de candidature, l&#8217;employeur est tenu de prendre pleinement note de la lettre de candidature d\u00e8s sa r\u00e9ception. Pour les cas anciens, cette obligation est bas\u00e9e sur l&rsquo;ancienne version de l&rsquo;article 81 SGB IX. Si les personnes agissant au nom de l&#8217;employeur n\u00e9gligent la r\u00e9f\u00e9rence au statut de personne gravement handicap\u00e9e et que l&#8217;employeur viole ainsi ses obligations en vertu de l&rsquo;article 81 SGB IX ancienne version, une discrimination due \u00e0 un handicap est pr\u00e9sum\u00e9e. Le comportement des personnes d\u00e9ploy\u00e9es dans sa sph\u00e8re d&rsquo;influence est imput\u00e9 \u00e0 l&#8217;employeur comme un manquement objectif \u00e0 ses obligations. Peu importe que les personnes impliqu\u00e9es soient en faute. L&#8217;employeur public doit inviter la personne gravement handicap\u00e9e qui postule \u00e0 un entretien conform\u00e9ment \u00e0 l&rsquo;article 82, phrase 2 SGB IX. Cette obligation ne s&rsquo;applique que si la personne gravement handicap\u00e9e manque manifestement de qualifications professionnelles.
