Il faut en s\u00e9parer la base contractuelle sur la base de laquelle la personne \u00e0 d\u00e9signer est l\u00e9galement tenue d&rsquo;assumer la fonction de d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es. Pour un salari\u00e9, il s\u2019agit g\u00e9n\u00e9ralement de la relation de travail. Si l&#8217;employ\u00e9 accepte sa nomination, ses droits et obligations contractuels de travail seront \u00e9galement \u00e9tendus pour inclure l&rsquo;\u00e9tendue des fonctions du d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es.[\/vc_column_text][vc_column_text css=\u00a0\u00bb.vc_custom_1700463293472{padding-top: 10px !important;padding-bottom: 10px !important;}\u00a0\u00bb]La mise en service n&rsquo;est g\u00e9n\u00e9ralement pas couverte par le droit de direction de l&#8217;employeur. Conform\u00e9ment \u00e0 l&rsquo;article 4f, paragraphe 3, phrase 4, premi\u00e8re moiti\u00e9 de la phrase BDSG, la nomination en tant que d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es peut \u00eatre r\u00e9voqu\u00e9e conform\u00e9ment \u00e0 l&rsquo;article 626 BGB. Si l&rsquo;activit\u00e9 du d\u00e9l\u00e9gu\u00e9 \u00e0 la protection des donn\u00e9es fait partie des fonctions du salari\u00e9 en vertu du contrat de travail, la r\u00e9vocation de la nomination ne peut \u00eatre effectivement r\u00e9voqu\u00e9e qu&rsquo;avec la cessation partielle simultan\u00e9e de la t\u00e2che particuli\u00e8re due en vertu du contrat de travail. La relation contractuelle de base et la nomination selon le BDSG sont inextricablement li\u00e9es. Une r\u00e9siliation partielle est ici autoris\u00e9e \u00e0 titre exceptionnel. La t\u00e2che particuli\u00e8re n&rsquo;est pas li\u00e9e en interne aux autres droits et obligations d\u00e9coulant de la relation de travail. Leur \u00e9limination n\u2019entra\u00eene donc pas une interf\u00e9rence unilat\u00e9rale et significative dans l\u2019ordre et la structure d\u2019\u00e9quivalence de l\u2019ensemble de la relation de travail. La possibilit\u00e9 d&rsquo;une r\u00e9siliation partielle est \u00e9galement n\u00e9cessaire en raison de l&rsquo;interdiction de discrimination \u00e9nonc\u00e9e \u00e0 l&rsquo;article 4f, paragraphe 3, phrase 3 du BDSG. Cela constituerait un d\u00e9savantage si la r\u00e9vocation de la nomination ne pouvait \u00eatre mise en \u0153uvre que par un pr\u00e9avis de rupture ou par la rupture de la relation de travail.
