Si la relation de travail prend fin \u00e0 un moment ant\u00e9rieur pour une autre raison, la cr\u00e9ance n&rsquo;existe plus et ne peut donc pas faire partie de la fortune transf\u00e9r\u00e9e aux h\u00e9ritiers conform\u00e9ment \u00e0 l&rsquo;article 1922 al. 1 BGB. Cela d\u00e9coule du libell\u00e9, de l\u2019historique et de l\u2019objectif du r\u00e8glement. Dans son arr\u00eat du 19 juin 2006 ( 1 AZR 340\/06 ), le Premier S\u00e9nat a d\u00e9cid\u00e9 que la cr\u00e9ation d&rsquo;une demande d&rsquo;indemnit\u00e9 de d\u00e9part conform\u00e9ment \u00e0 l&rsquo;article 1a al. 1 phrase 2 KSchG, si les autres conditions sont remplies, cela n&rsquo;est pas emp\u00each\u00e9 par le fait que l&#8217;employeur informe le salari\u00e9 dans la lettre de licenciement du montant pr\u00e9vu et que celui-ci est inf\u00e9rieur au montant l\u00e9gal si l&#8217;employeur indique \u00e9galement qu&rsquo;il en veut un Verser une indemnit\u00e9 de d\u00e9part au montant pr\u00e9vu par la loi.[\/vc_column_text][vc_column_text css=\u00a0\u00bb.vc_custom_1700475682872{padding-top: 10px !important;padding-bottom: 10px !important;}\u00a0\u00bb]Cela s&rsquo;applique ind\u00e9pendamment du fait que la cr\u00e9ance r\u00e9sulte d&rsquo;un acte juridique bilat\u00e9ral fond\u00e9 sur une offre de l&#8217;employeur qui a \u00e9t\u00e9 implicitement accept\u00e9e par le salari\u00e9 en laissant expirer le d\u00e9lai d&rsquo;action, ou d&rsquo;un acte juridique unilat\u00e9ral. sur la base d&rsquo;une d\u00e9claration d&rsquo;intention correspondante de l&#8217;employeur, dans laquelle l&rsquo;expiration du d\u00e9lai de r\u00e9clamation est consid\u00e9r\u00e9e comme une circonstance purement factuelle. Si, du point de vue du b\u00e9n\u00e9ficiaire, l&rsquo;indication du montant quantifi\u00e9 sert uniquement \u00e0 fournir des informations sur le montant de l&rsquo;indemnit\u00e9 de d\u00e9part que l&#8217;employeur consid\u00e8re comme correct, la d\u00e9claration l\u00e9gale de l&#8217;employeur correspond \u00e0 la r\u00e9glementation l\u00e9gale. La question de savoir si l&rsquo;indication d&rsquo;un montant quantifi\u00e9 est purement informatif ou a un caract\u00e8re juridique doit \u00eatre d\u00e9termin\u00e9e par interpr\u00e9tation. Dans sa d\u00e9cision, le Premier S\u00e9nat a en outre d\u00e9clar\u00e9 que les r\u00e9glementations l\u00e9gales collectives visant \u00e0 compenser les d\u00e9savantages \u00e9conomiques r\u00e9sultant d&rsquo;un changement d&rsquo;exploitation peuvent pr\u00e9voir la cr\u00e9dibilit\u00e9 des prestations conform\u00e9ment \u00e0 l&rsquo;article 1a du KSchG.[\/vc_column_text][vc_column_text css=\u00a0\u00bb.vc_custom_1700475693991{padding-top: 10px !important;padding-bottom: 10px !important;}\u00a0\u00bb]Cela ne viole pas la finalit\u00e9 des noms collectifs en question. Les demandes d&rsquo;indemnit\u00e9s de licenciement selon l&rsquo;article 1a du KSchG servent \u00e9galement \u00e0 compenser les d\u00e9savantages \u00e9conomiques dus \u00e0 la perte d&rsquo;un emploi. La r\u00e9glementation de l&rsquo;article 1a du KSchG vise principalement \u00e0 \u00e9viter les poursuites en mati\u00e8re de protection contre le licenciement. Toutefois, les moyens pr\u00e9vus par la loi pour cr\u00e9er des demandes d&rsquo;indemnit\u00e9s de d\u00e9part pour le salari\u00e9 licenci\u00e9 ont pour objectif de compenser ou d&rsquo;att\u00e9nuer les inconv\u00e9nients \u00e9conomiques de la perte d&#8217;emploi.[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row
