En sentencia de 15 de julio de 2009 (5 AZR 867\/08), el Quinto Senado se ocup\u00f3 de la compensaci\u00f3n de las guardias nocturnas al referirse al convenio colectivo federal para empleados en versi\u00f3n eclesi\u00e1stica (BATKF). Seg\u00fan el art\u00edculo 48a, apartado 4 de la BATKF, los empleados tienen derecho a vacaciones adicionales si trabajan un determinado n\u00famero m\u00ednimo de horas por la noche. Seg\u00fan el tenor del apartado 6, se excluye la reclamaci\u00f3n para los servicios de guardia nocturna realizados fuera del horario laboral habitual. Desde el 1 de enero de 2004, las guardias se consideran tiempo de trabajo en el sentido de la nueva versi\u00f3n del art\u00edculo 2 de la ArbZG. \u00a7 2 ArbZG, el reglamento de excepci\u00f3n se desv\u00eda del modelo legal de tal manera que resulta en una desventaja irrazonable. Por lo tanto, la cl\u00e1usula contenida en el art\u00edculo 48a, apartado 6 de la BATKF no es aplicable, de modo que las horas de guardia nocturnas trabajadas fuera del horario laboral normal tambi\u00e9n deben compensarse con vacaciones adicionales de conformidad con el art\u00edculo 48a, apartado 4 de la BATKF. <\/p>\n<\/div>\n
