Tras la posterior insolvencia del empresario, el empleado ya no pudo hacer efectivos sus derechos de indemnizaci\u00f3n por despido de un plan social y se puso en contacto con el abogado alegando que hab\u00eda incumplido sus obligaciones en virtud del contrato legal celebrado con el comit\u00e9 de empresa. En su sentencia del 24 de agosto de 2006 (8 AZR 414\/05), el Octavo Senado decidi\u00f3 que un abogado del comit\u00e9 de empresa no es responsable ante los empleados por el mal cumplimiento de su contrato. Si el comit\u00e9 de empresa encarga a un abogado la tarea de negociar una conciliaci\u00f3n de intereses y un plan social, \u00e9ste deber\u00e1 asesorar y representar al comit\u00e9 de empresa en sus tareas jur\u00eddicas colectivas de conformidad con los art\u00edculos 111 y siguientes de la BetrVG. Esto no resulta en un mandato para representar los intereses individuales de los empleados.
