[vc_row triangle_shape=\u00bbno\u00bb][vc_column][vc_column_text]Seg\u00fan decisi\u00f3n del Noveno Senado del 11 de abril de 2006 (9 AZR 610\/05), la jurisprudencia establecida del Tribunal Federal del Trabajo sobre el control general del contenido de las cl\u00e1usulas de reembolso, publicada antes de que entraran en vigor los art\u00edculos 305 y siguientes del BGB en vigor, seg\u00fan la cual el trabajador debe asumir los costes y debe participar en una formaci\u00f3n financiada por el empresario si abandona la relaci\u00f3n laboral antes de que hayan transcurrido determinados plazos. En casos excepcionales, dichas obligaciones de pago pueden resultar ineficaces debido a un deterioro excesivo de la libertad de elecci\u00f3n de carrera del empleado relacionada con el trabajo (Art. 12 P\u00e1rr. 1 Frase 1 GG). Una cl\u00e1usula de reembolso en el contrato de trabajo tipo, seg\u00fan la cual un trabajador debe en cualquier caso (proporcionadamente) reembolsar los costes de formaci\u00f3n soportados por el empleador si la relaci\u00f3n laboral finaliza antes de un determinado per\u00edodo de tiempo, es demasiado amplia en t\u00e9rminos de los hechos que desencadenan la obligaci\u00f3n de reembolso. Generar\u00eda una obligaci\u00f3n de reembolso incluso si el motivo de la terminaci\u00f3n de la relaci\u00f3n laboral entra exclusivamente dentro de la esfera de responsabilidad o riesgo del empleador. Tal cl\u00e1usula no tiene en cuenta los intereses mutuamente reconocidos de ambas partes contratantes, sino \u00fanicamente los del empleador. Perjudica injustamente al empleado en contra de las exigencias de la buena fe (art\u00edculo 307, apartado 1, frase 1 del BGB). No hay raz\u00f3n para limitar una cl\u00e1usula de reembolso demasiado amplia a los casos en los que el motivo del despido cae dentro de la esfera de responsabilidad o riesgo del trabajador mediante una reducci\u00f3n v\u00e1lida o una interpretaci\u00f3n complementaria del contrato.
