Seg\u00fan sentencia del Noveno Senado de 18 de marzo de 2008 (9 AZR 186\/07), un contrato de consumo en el sentido de. Art\u00edculo 310, apartado 3 del BGB. Para los contratos de trabajo, la jurisprudencia ha reconocido que se trata de contratos entre empresarios (empleadores) y consumidores (empleados) en el sentido de: Art\u00edculo 310, apartado 3, leyes del BGB. No se aplica nada diferente a un \u201ccontrato de voluntariado\u201d. Una cl\u00e1usula relativa al reembolso de servicios debe ser comprensible y clara para la persona obligada a reembolsar de conformidad con el art\u00edculo 307, apartado 1, frase 2 del BGB. Un acuerdo paralelo al \u00abcontrato de voluntariado\u00bb estipula que las indemnizaciones y becas de formaci\u00f3n que se conceder\u00e1n durante el per\u00edodo de estudios puros s\u00f3lo se pondr\u00e1n a disposici\u00f3n en forma de \u00abpr\u00e9stamo\u00bb y, una vez finalizados con \u00e9xito los estudios en 60 meses, a trav\u00e9s de futuros \u201ctrabajos\u201d con el prestamista \u201cdeben ser desmantelados\u201d, cuando se celebre el contrato debe estipularse, al menos como marco, qu\u00e9 y bajo qu\u00e9 condiciones debe desarrollarse la \u201cactividad profesional\u201d con el prestamista.
