Seg\u00fan decisi\u00f3n del S\u00e9ptimo Senado del 16 de abril de 2008 ( 7 ABR 4\/07 ), en caso de cooperaci\u00f3n empresarial entre dos empresas que se limite al suministro de personal, no se crea ninguna operaci\u00f3n conjunta si la empresa que proporciona el personal no participa en la consecuci\u00f3n del objeto operativo de la otra empresa. Salvo prueba en contrario, la cooperaci\u00f3n entre los empresarios que participan en una operaci\u00f3n conjunta se realiza normalmente en forma de empresa BGB. Sin embargo, el acuerdo sobre la gesti\u00f3n conjunta de una operaci\u00f3n unitaria necesario para la aceptaci\u00f3n de una operaci\u00f3n conjunta tambi\u00e9n puede cumplirse con otras formas legales de cooperaci\u00f3n. Las disposiciones del C\u00f3digo Municipal de Hesse sobre las actividades econ\u00f3micas de los municipios no entran en conflicto con un acuerdo sobre la gesti\u00f3n de una empresa conjunta formada por una persona jur\u00eddica de Derecho privado y un municipio.
