Seg\u00fan decisi\u00f3n del S\u00e9ptimo Senado del 16 de octubre de 2008 (7 AZR 185\/07), esto tambi\u00e9n se aplica si la incapacidad para volar se debe a un accidente de trabajo del que es responsable el empleador. No contradice el principio general de igualdad si las partes en la negociaci\u00f3n colectiva tratan la (con toda probabilidad) permanente incapacidad para volar de manera diferente que la p\u00e9rdida temporal o la retirada del permiso o confirmaci\u00f3n oficial. La condici\u00f3n posterior tambi\u00e9n est\u00e1 objetivamente justificada. \u00a7\u00a7 21, 14 apartado 1 TzBfG. Sin embargo, la p\u00e9rdida de la capacidad de volar no constituye en s\u00ed misma una raz\u00f3n f\u00e1ctica suficiente para la condici\u00f3n posterior: s\u00f3lo la falta de oportunidades de empleo por parte del empleador derivada de la p\u00e9rdida de la capacidad de volar justifica la terminaci\u00f3n de la relaci\u00f3n laboral sin previo aviso. Si despu\u00e9s de determinar la incapacidad para volar no existe un trabajo gratuito y adecuado, no tendr\u00eda sentido mantener la relaci\u00f3n contractual anterior porque el empleador ya no puede contratar al empleado y el empleado ya no puede proporcionar el servicio acordado contractualmente debido a la incapacidad para volar.[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"
