[\/vc_column_text][vc_column_text css=\u00bb.vc_custom_1700464830889{padding-top: 10px !important;padding-bottom: 10px !important;}\u00bb]La cuesti\u00f3n ante el Noveno Senado era decidir si un empleado empleado como conductor de una empresa de transporte tiene derecho a su empleador para que le reembolse los gastos incurridos para adquirir la llamada tarjeta de conductor. Debido al Reglamento (CE) n\u00ba 561\/206 del Parlamento Europeo y del Consejo, a partir del 1 de mayo de 2006 se exigen tac\u00f3grafos digitales para los camiones reci\u00e9n matriculados con un peso total determinado o superior, en lugar de los dispositivos de control anal\u00f3gicos anteriores. Para utilizar este tac\u00f3grafo, cada conductor necesita la llamada tarjeta de conductor, que contiene un chip con los datos personales del conductor y no est\u00e1 vinculada al uso de un veh\u00edculo espec\u00edfico. En sentencia de 16 de octubre de 2007 (9 AZR 170\/07), el Noveno Senado decidi\u00f3 que el empleado no tiene derecho al reembolso de los gastos incurridos por su empleador en la compra de la tarjeta. En particular, esta afirmaci\u00f3n no se deriva de manera an\u00e1loga del art\u00edculo 670 del C\u00f3digo Civil alem\u00e1n (BGB). El empleado tiene su propio inter\u00e9s en adquirir la tarjeta de conductor. Se expide personalmente y le permite conducir camiones con un peso total autorizado igual o superior a 3,5 t.
