S\u00f3lo pueden surgir si se ordena un trabajo fuera del horario de trabajo normal o programado del empleado. El servicio de guardia, por su parte, se produce cuando el trabajador debe permanecer en un lugar designado por el empleador con fines operativos, sin que sea necesario que est\u00e9 alerta, para poder iniciar inmediatamente sus actividades laborales completas si fuera necesario. Esto corresponde a la definici\u00f3n del art\u00edculo 15, p\u00e1rrafo. Sexta cosa. Seg\u00fan sentencia del Sexto Senado de 25 de abril de 2007 (6 AZR 799\/06), en general se permite al empleador determinar qu\u00e9 tipo de servicio debe prestar el empleado en el ejercicio de su derecho a dar instrucciones. Puede, dentro del \u00e1mbito de lo permitido por la ley, los convenios y contratos colectivos, ordenar turnos de guardia, turnos de guardia o horas extraordinarias y tambi\u00e9n tiene derecho a cambiar el orden establecido de antemano en una lista de turnos. Si un empleado est\u00e1 obligado legalmente a estar de guardia despu\u00e9s del horario laboral est\u00e1ndar, el empleador puede utilizar el servicio de guardia ya especificado si hay trabajo que realizar m\u00e1s all\u00e1 del final del horario laboral est\u00e1ndar.
