{"id":14881,"date":"2023-11-20T14:33:59","date_gmt":"2023-11-20T13:33:59","guid":{"rendered":"https:\/\/www.kanzlei-steinwachs.de\/lexicon\/"},"modified":"2023-12-08T07:02:46","modified_gmt":"2023-12-08T06:02:46","slug":"lexicon","status":"publish","type":"page","link":"https:\/\/www.kanzlei-steinwachs.de\/en\/lexicon\/","title":{"rendered":"Lexicon"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"> Information <\/p>\n\n<p class=\"wp-block-paragraph\">The remedial procedure is the <strong>first part of the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_verwaltungsverfahren#\">objection procedure<\/a><\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">After filing an objection <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_verwaltungsverfahren#\">against<\/a> an <a href=\"https:\/\/www.anwalt24.de\/lexikon\/verwaltungsakt#\">administrative act<\/a>, <a href=\"https:\/\/www.anwalt24.de\/lexikon\/behoerde#\">the authority issuing the administrative act<\/a> (output authority) is required to carry out a remedial procedure.<\/p>\n\n<p class=\"wp-block-paragraph\">The facts on which <a href=\"https:\/\/www.anwalt24.de\/lexikon\/verwaltungsakt#\">the administrative act<\/a> is based must be fully re-examined by the originating authority to determine their legality and appropriateness. Newly presented facts or a change in the legal situation must be taken into account. The exam includes: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_zulaessigkeit#\">admissibility of the objection<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_begruendetheit#\">the merits of the objection<\/a><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The originating authority has the opportunity to look into the matter again and review its decision. <strong>She has the following decision options<\/strong>: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>If she wants to correct her initial decision, she can remedy the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_verwaltungsverfahren#\">objection<\/a>. A remedial notice is <a href=\"https:\/\/www.anwalt24.de\/lexikon\/abhilfebescheid#\">issued.<\/a><\/li>\n\n\n\n<li>If it considers its initial decision to be legal, it forwards the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_verwaltungsverfahren#\">objection<\/a> to the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruchsbehoerde#\">objection authority<\/a>, which then makes a decision in an <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruchsbescheid#\">objection<\/a> notice.<\/li>\n\n\n\n<li>If it considers the <a href=\"https:\/\/www.anwalt24.de\/lexikon\/widerspruch_-_verwaltungsverfahren#\">objection<\/a> to be only partially justified, it can also provide partial relief.
